These Terms of Service (the "Terms") are a binding agreement between you and Sai IT Solutions Ltd ("we", "us", "our") governing your access to and use of the Aethyn residential proxy service (the "Service"). Aethyn is a brand operated by Sai IT Solutions Ltd, a company registered in Ras Al Khaimah with its registered office at Innovation City Free Zone, Ras Al Khaimah, United Arab Emirates. By creating an account, purchasing bandwidth, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service
Aethyn resells residential proxy bandwidth under two products — Premium (residential) and Elite (premium residential) — accessible over HTTP and SOCKS5, with country, state, city, and ISP targeting and sticky or rotating sessions. The underlying IP pools are sourced from third-party upstream providers; we do not own the residential endpoints, and coverage, availability, rotation, and success rates depend on those networks and on the sites you connect to.
2. Registration and Account
You must be at least 18 and able to enter into a binding contract. You agree to provide accurate, current information and to keep it up to date; disposable or temporary email addresses are not permitted. You are responsible for your account credentials and proxy credentials and for all activity under them, and must notify us promptly at support@aethyn.io of any suspected unauthorised use. Because residential proxies can be misused, we may require identity or payment verification (KYC), including a payment method on file for higher-risk sign-ups (for example, from datacenter, VPN, or hosting networks), and we may refuse, limit, or revoke access where verification fails.
3. Acceptable Use
You are solely responsible for your traffic and for complying with all laws of every jurisdiction your activity touches. You must not use the Service to:
- breach any applicable law or regulation, or facilitate anyone else doing so;
- gain unauthorised access to any system, account, or data, or perform hacking, credential stuffing, brute-forcing, or security circumvention;
- distribute malware, operate a botnet or command-and-control, or conduct denial-of-service (DoS/DDoS) attacks;
- send spam or unsolicited bulk messaging, or harvest contact data for it;
- commit fraud, payment/card fraud, phishing, identity theft, or account takeover;
- access, create, or distribute child sexual abuse material (CSAM) or any content that exploits minors — zero tolerance, reported immediately to the authorities;
- infringe intellectual property rights, or collect personal or sensitive data in breach of privacy law;
- target government, military, banking, or critical-infrastructure systems for abuse;
- violate sanctions or export controls, or evade them (see Section 9); or
- resell, sublicense, or share the Service or your credentials except as expressly permitted.
You must respect the terms and rate limits of the destinations you access where required by law. We may set fair-use limits to protect the network and our upstream relationships.
4. Monitoring, Suspension and Termination
We may monitor use of the Service for security, billing, and compliance, and may suspend or terminate your account immediately and without refund for breach of these Terms, non-payment, fraud, abuse, chargebacks, sanctions or legal risk, or where required by an upstream provider, a target site, or law. We may preserve and disclose information to comply with law or lawful requests and to protect the Service, our users, or third parties. On termination, your right to use the Service ends and any unused balance is forfeited where termination is for cause.
5. Fees, Billing and Payments
Bandwidth is metered and charged per gigabyte at the prices shown at purchase or in your plan. You fund a prepaid wallet from which usage and fees are deducted; you may enable auto top-up, which authorises us and our payment processors to charge your saved method to replenish your balance. We accept card payments (via Stripe) and cryptocurrency (via B2BInPay). Prices and fair-use limits may change prospectively. You are responsible for all applicable taxes; UAE value-added tax (VAT) at 5% applies where required, and you may provide a Tax Registration Number. The Service may be throttled, paused, or suspended when your balance is exhausted or a payment fails.
6. Refunds
All sales are final and balances, bandwidth, top-ups, and plans are non-refundable except as set out in our Refund Policy and except where mandatory consumer law provides otherwise. See the Refund Policy for details.
7. Chargebacks and Disputes
If you believe you were charged in error, contact support@aethyn.io first. Initiating a chargeback or payment reversal without contacting us is a breach of these Terms; we may suspend or close your account, block future sign-ups, and recover amounts owed (including fees and costs).
8. Intellectual Property
The Service, software, brand, and all related materials are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose during your subscription. You retain ownership of your data; if you send us feedback, you grant us a perpetual, royalty-free licence to use it to improve the Service.
9. Sanctions, Export and Restricted Territories
You represent that you are not subject to, and will not use the Service in violation of, applicable UAE, UN, US, EU, or UK sanctions or export controls. We do not provide the Service to persons in, or for the benefit of, Cuba, Iran, North Korea, Syria, Myanmar, or the occupied Ukrainian regions of Crimea, Sevastopol, Donetsk, Luhansk, Zaporizhzhia, and Kherson, or any other territory subject to comprehensive sanctions or embargo under applicable law. We may freeze accounts and report to the authorities without notice where required.
10. Beta Features and Aggregated Data
Features identified as beta or experimental are provided "as is" and may change or be withdrawn. We may create and use aggregated and de-identified data (which does not identify you) to operate, secure, and improve the Service.
11. Modifications
We may modify the Service, these Terms, and the incorporated policies at any time. Material changes take effect when posted (or as stated in the notice); your continued use after changes take effect constitutes acceptance. If you do not agree, stop using the Service.
12. Warranty Disclaimer and Limitation of Liability
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, error-free, or that any specific IP, location, ISP, session, or success rate will be available. Availability is governed solely by the SLA.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, or for your use of the proxies or your traffic. Our total aggregate liability arising out of or relating to the Service is limited to the greater of (i) the fees you paid to us in the three months before the event giving rise to the claim, or (ii) USD 50. Nothing in these Terms excludes liability that cannot be excluded by law (such as for fraud, willful misconduct, or death or personal injury caused by negligence), and your mandatory consumer rights remain unaffected.
13. Indemnification
You will indemnify, defend, and hold harmless Sai IT Solutions Ltd and its officers, employees, and suppliers from any claim, loss, liability, or expense (including reasonable legal fees) arising from your use of the Service, your traffic, your content, or your breach of these Terms or applicable law.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the United Arab Emirates as applied in Ras Al Khaimah. The courts of Ras Al Khaimah have jurisdiction, except that either party may instead elect to resolve any dispute by binding arbitration administered by the Dubai International Arbitration Centre (DIAC), seated in Ras Al Khaimah, conducted in English. To the maximum extent permitted by law, disputes will be resolved individually and you and we waive any right to participate in a class, collective, or representative proceeding. Nothing here removes a consumer's non-waivable right to bring proceedings in the courts of their place of residence.
15. Miscellaneous
You may not assign these Terms without our consent; we may assign them to an affiliate or successor. We are not liable for delays or failures caused by events beyond our reasonable control (force majeure). If any provision is held unenforceable, the rest remains in effect. These Terms (with the Privacy Policy, Refund Policy, and SLA) are the entire agreement between us regarding the Service. We may give notices by email to your account address or via the dashboard; material legal notices are deemed received 24 hours after sending.
